Terms of Service

Please read these terms carefully before engaging P.M Electrical Services for electrical engineering services

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and P.M Electrical Services ("Company," "we," "us," or "our"), a registered business in Ghana (BN302412016). By engaging our electrical engineering services, requesting a quote, or using our website, you agree to be bound by these Terms and all applicable laws and regulations of Ghana.

If you do not agree with any part of these terms, please do not engage our services or use our website.

These terms apply to all clients, website visitors, and any party entering into a service agreement with P.M Electrical Services.

2. Services Provided

P.M Electrical Services provides professional electrical engineering services including but not limited to:

  • Low-voltage electrical power systems (transformers, switchgear, breakers, distribution panels)
  • Industrial electrical control panel design, construction, and installation
  • Water pumping systems (sales, installation, maintenance including NFPA 20 fire pumps)
  • Automation and control systems for industrial applications
  • Preventive maintenance and repair services
  • Solar energy system installation and integration
  • Electrical supplies and equipment sales (Geya Electrical products and allied brands)

All services are provided in accordance with Ghanaian electrical safety standards, regulations, and industry best practices.

3. Service Agreements and Quotations

3.1 Quotations

All quotations provided by P.M Electrical Services are:

  • Valid for 30 days from the date of issue unless otherwise specified
  • Based on information provided by the client at the time of request
  • Subject to site inspection and verification of actual conditions
  • Exclusive of VAT unless stated otherwise

3.2 Service Commencement

Services will commence only after:

  • Written acceptance of our quotation
  • Receipt of required deposit (typically 50% of total project cost)
  • Signing of a formal service agreement for projects exceeding GHS 10,000
  • Completion of site survey and risk assessment where applicable

3.3 Project Timeline

Project timelines are estimates based on normal working conditions. Delays caused by factors beyond our control (client delays, material supply issues, weather, government restrictions, etc.) may extend the completion date without penalty to P.M Electrical Services.

4. Payment Terms and Conditions

4.1 Payment Schedule

Standard payment terms:

  • Deposit: 50% of total project cost upon contract signing
  • Progress Payments: 40% upon substantial completion of work
  • Final Payment: 10% upon project completion and client acceptance
  • Maintenance Contracts: Payable quarterly or annually in advance
  • Emergency Services: Payment due within 7 days of service completion

4.2 Accepted Payment Methods

  • Bank transfer to designated P.M Electrical Services account
  • Mobile money (MTN, Vodafone, AirtelTigo)
  • Cheque (subject to clearance before work commencement)
  • Cash for amounts under GHS 5,000

4.3 Late Payments

Payments not received within the specified timeframe will incur:

  • A late payment fee of 5% of the outstanding amount per month
  • Suspension of ongoing work until payment is received
  • Withholding of warranty services until all payments are settled
Important Notice

Ownership of all equipment, materials, and installations remains with P.M Electrical Services until full payment is received.

5. Client Responsibilities

The client agrees to:

Provide accurate project requirements and site information
Ensure safe site access for our technicians and equipment
Obtain necessary permits and approvals where required
Provide power, water, and other utilities as needed during installation
Ensure third-party contractors do not interfere with our work
Notify us immediately of any concerns or issues during project execution

6. Warranties and Guarantees

6.1 Workmanship Warranty

P.M Electrical Services warrants that all work will be performed in a professional and workmanlike manner in accordance with industry standards. We provide:

  • Installation Work: 12-month warranty on labor and workmanship
  • Control Panels: 24-month warranty on custom-built panels
  • Water Pump Systems: Warranty as per manufacturer specifications (typically 12-36 months)

6.2 Equipment Warranty

Equipment supplied by us carries manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects beyond our control.

6.3 Warranty Exclusions

Warranties do not cover:

  • Damage caused by improper use, neglect, or unauthorized modifications
  • Normal wear and tear
  • Damage from power surges, lightning, or natural disasters
  • Work performed by third parties after our installation
  • Failure to follow recommended maintenance schedules

7. Limitation of Liability

To the maximum extent permitted by Ghanaian law:

  • Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim
  • We are not liable for indirect, consequential, or special damages including but not limited to loss of profits, business interruption, or data loss
  • We are not liable for delays or failures caused by circumstances beyond our reasonable control (force majeure)
  • Claims must be made within 30 days of discovery of the issue

Disclaimer:

  • Services are provided "as is" with no implied warranties beyond those explicitly stated
  • We do not guarantee uninterrupted operation of electrical systems due to external factors
  • Client is responsible for maintaining adequate insurance coverage for their property

8. Safety and Regulatory Compliance

P.M Electrical Services is committed to safety and regulatory compliance:

  • All work complies with Ghanaian electrical safety codes and standards
  • We maintain appropriate insurance coverage for our operations
  • Our technicians follow strict safety protocols and use appropriate PPE
  • We conduct risk assessments before commencing work on site
  • NFPA 20 certified for fire pump system installations

Clients must ensure their facilities comply with applicable safety regulations and maintain safe working conditions for our personnel.

9. Cancellation and Termination

9.1 Client Cancellation

Clients may cancel services with the following conditions:

  • Before work commencement: Deposit is refundable minus 10% administrative fee
  • After work commencement: Client pays for work completed plus materials purchased, with no refund of deposit
  • Cancellation notice: Must be provided in writing

9.2 Company Termination

We reserve the right to terminate services if:

  • Payment terms are not met
  • Client fails to fulfill their responsibilities
  • Unsafe site conditions persist after notification
  • Client behavior is threatening or abusive to our staff

10. Emergency and 24/7 Services

We provide 24/7 emergency services for water pumping systems and critical electrical failures:

  • Response Time: Within 2 hours for active maintenance contract clients
  • Emergency Rates: Premium rates apply for after-hours, weekends, and public holidays (1.5x standard rate)
  • Call-out Fee: Minimum GHS 500 for emergency services
  • Priority: Maintenance contract clients receive priority response

11. Intellectual Property and Confidentiality

All designs, drawings, specifications, and technical documentation created by P.M Electrical Services remain our intellectual property unless otherwise agreed in writing.

We respect client confidentiality and will not disclose sensitive project information to third parties without permission, except as required by law.

12. Dispute Resolution

In the event of any dispute arising from these Terms or our services:

  • Negotiation: Parties will first attempt to resolve disputes through good-faith negotiation
  • Mediation: If negotiation fails, disputes will be referred to mediation
  • Arbitration: Unresolved disputes may be submitted to arbitration under Ghanaian law
  • Jurisdiction: The courts of Ghana shall have exclusive jurisdiction over any legal proceedings

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of Ghanaian courts.

14. Data Protection and Privacy

We collect and process client information in accordance with our Privacy Policy and applicable Ghanaian data protection principles. Client information is used solely for service delivery, project management, and communication purposes.

15. Changes to Terms

P.M Electrical Services reserves the right to modify these Terms at any time. We will notify clients of material changes by:

  • Posting updated terms on our website with a new "Last Updated" date
  • Email notification to active clients for significant changes
  • Providing 30 days' notice before changes take effect

Continued use of our services after changes become effective constitutes acceptance of the revised terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under Ghanaian law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with any written service agreements, quotations, and our Privacy Policy, constitute the entire agreement between the client and P.M Electrical Services regarding the services and supersede all prior agreements and understandings.
